Andy Toft

I grew up in west suburban Chicago, in a Cubs household.  After high school I attended the University of Nebraska – Lincoln, receiving a Bachelor of Science in Business Administration in 1979 and my law degree in 1982.  My father was a native of Nuckolls County, Nebraska, where my ancestors were early settlers.  Hence the attraction to Nebraska.  I am Dad to two fine young men, the older son a graduate of the University of Washington and the younger son a graduate of the University of Colorado – Boulder.

After law school I moved to Denver without first having found a legal position and was admitted to the Colorado bar in October 1982.  I began practicing in January 1983 at a firm in Englewood, CO.  With that firm and since, my practice has been oriented towards commercial litigation, creditor’s rights both in and out of bankruptcy, commercial foreclosures and receiverships, and a wide variety of real estate issues.  From mid-1990 to late 1997 I was in-house with a bank and then a privately held group of companies.  In mid-1998 I opened my own practice and continued practicing as a sole practitioner until early 2019, still focusing on commercial litigation and creditor’s rights in bankruptcy, real estate litigation, commercial foreclosures and receiverships, commercial collections and loan workouts, post-judgment recovery and Article 9 issues.  In February 2020 I began my current position as Of Counsel with Hoffman, Nies, Dave & Meyer LLP.

Since I began practicing have handled litigation in Colorado’s county courts and district courts, as well as cases before the Colorado Court of Appeals.  I have also handled cases in the United States District Court for the District of Colorado and the United States Bankruptcy Court for the District of Colorado, as well as federal courts in several other states.  For several years, I edited and updated the chapter in the Colorado Methods of Practice series “Quieting Title Under Rule 105.”

While my years practicing has afforded me a broad base of experience and knowledge, so have my years being involved in professional associations.  I have been an active member of the American, Colorado, and Denver bar associations, as well as the Turnaround Management Association.  In addition, I have been a member of the American Bankruptcy Institute for over 20 years.  While much of my professional volunteer time has related to my areas of practice, I have also been involved in several local and national governance functions and learned how to help colleagues, as well as organizations, achieve their goals.  One of my favorite volunteer projects has been involvement with the Colorado Bar Association’s Legislative Policy Committee.  While Colorado’s General Assembly is in session, the LPC reviews legislation on a weekly basis.  This has been and continues to be one of the greatest intellectual experiences of my career, not to mention being able to learn from watching government work from a first-row seat.  I bring all these volunteer experiences to bear when representing clients.

On a more personal level while my sons were in the Denver Public Schools, I was a member of the Collaborative School Committee at their K-8 from 2005-2014.  I also helped organize a Cub Scout pack at the school and was pack chair 2006-2009.  That experience taught me that grade school kids can deflate a lawyer’s ego with absolutely no malice aforethought.
